In a new lawsuit filed Friday, a T-Mobile employee was accused of stealing explicit images from a customer’s phone during a trade-in transaction at one of the company’s retail stores.

This incident mirrors at least eight previous lawsuits against T-Mobile, which highlight the company’s failure to safeguard sensitive consumer data, reports NBC News.

“For almost a decade, T-Mobile customers across the United States have regularly reported, evidenced by news stories and lawsuits, instances of retail store employees stealing their intimate videos, explicit photos, and bank account [information],” stated the lawsuit, filed in Washington State court.

“Nevertheless, T-Mobile has failed to implement any common-sense security hardware or software to protect consumers from their data and privacy being exploited during ordinary transactions at the T-Mobile store,” the documents added.

The suit detailed one victim’s experience from last October, when she went to upgrade her iPhone at a T-Mobile store at the Columbia Center Mall in Kennewick, roughly 200 miles southeast of Seattle.

During the visit, she entrusted her old device to an employee for a data transfer, during which he allegedly discovered nude images and a video of her having sex with her partner, and sent those files to himself via Snapchat.

Later that evening, the victim (labeled “Jane Doe” in the complaint) discovered the content had been sent to an unknown Snapchat account, which was later traced back to the employee.

When she returned to the T-Mobile store with her mother to speak to the manager, staff claimed there had been no trade-ins the day Jane came in, until mall security and local police found her old phone in the back room.

“Rather than helping Jane out in the face of the sexual privacy crime, the T-Mobile manager said if Jane wanted access back to the old device that had been weaponized against her, Jane would need to pay them the amount that they had discounted her for the trade-in,” the lawsuit said.

The employee determined to be responsible for the stolen material was eventually charged with first-degree computer trespass, a felony, and disclosing intimate images. He pleaded guilty last month, the suit added.
