Brownsville PUB to hold special meeting; CEO on agenda - Brownsville Herald

The Brownsville Public Utilities Board will hold a special meeting Monday and an item pertaining to CEO John Bruciak is on the agenda.

According to the agenda for Monday’s meeting there will be “deliberations regarding the appointment, employment, evaluation, reassignment duties, or discipline of the Chief Executive Officer of the Brownsville Public Utilities Board.”

The meeting begins at 5 p.m. at the BPBUB Annex Building Board Room at 1425 Robinhood Drive.

Bruciak has been under scrutiny regarding the release of an audit pertaining to the failed Tenaska project that found BPUB management contrived an electrical capacity shortage and intentionally used “outdated and overstated” load forecast data to justify its pursuit of the project.

The BPUB held a meeting Oct. 11 where many members of the public said action should be taken against Bruciak. Resident Susan Ruvalcaba said residents were victimized by BPUB and asked that Bruciak immediately be placed on leave.

In executive session, the BPUB discussed the results of the audit and later released a statement, which in part read “We understand and we feel the tremendous concern conveyed to (BPUB) by the public. So once we have taken the above steps we aim to engage with the city to address in an expedited fashion the mistakes that were made, the root causes and make whatever structural and/or personnel are changes are needed to ensure the (BPUB) ship returns quickly without delay to its core mission and the major challenges we and the entire utility industry are facing.”

The audit was released Oct. 4 by the Brownsville City Commission which in 2021 requested an audit on BPUB be conducted. A day after the audit was released an online petition was created calling for the firing an investigation of Bruciak. As of Saturday, the petition contained 571 signatures.

Another item to also be discussed in executive session reads “Meeting with Board’s legal counsel for advice about contemplated and pending court and administrative litigation on matters in which the duty of the attorney under the Texas Disciplinary Rules of Professional Conduct conflicts with Chapter 551…including among other matters the CRI Forensic Audit.”

While CRI found no evidence that BPUB’s board intentionally misled the city during key decisions and acknowledged that board members may have had difficulty grasping all the highly technical information being presented to them by BPUB management and consultants, the analysis concluded nonetheless that more questions should have been asked.
