An investment company under investigation by the IRS into a possible fraudulent land donation scheme can’t squash a separate IRS summons on the company because the business is a distinct entity from its agents, the US Court of Appeals for the Fourth Circuit.
Equity Investment Associates donated more than 1,200 acres of North Carolina land as a conservation easement, property which is donated to be protected “in perpetuity” under tax code Section 170(h). In its 2018 tax return, Equity sought $223 million on more than 1,900 acres of land.
