Connecticut’s state Senate just approved legislation imposing new administrative tasks and penalties on your business related to recalling laid off employees in certain industries.

It's now on its way to the state House unless you help stop it!

SB 658 requires you to recall your own, or a third party’s laid off employees in order of seniority if they were performing janitorial, building maintenance, security, food service, or hotel hospitality work in your office building and laid off at any time between March 10, 2020 and Dec. 31, 2024. 

The bill is yet another tremendous overreach by the legislature’s Labor and Public Employees Committee. Why should you oppose it?

  • It requires you to recall employees, or a third party’s employee that was performing service in your office, solely based on their seniority—not productivity, work, or disciplinary history, skill set, etc.
  • You will be required to send text messages to each laid off employee, or third party’s employee, any time a job that may match their skill set becomes available in your workplace. 
  • It allows employees or third party employees five days to decide whether to take the available job or not—delaying you from filling job vacancies and allowing them to skirt work search obligations under the state’s unemployment compensation laws. 
  • Requires you to reveal the identity of any new hires to laid off employees, or the employees of a third party—potentially risking the safety of those individuals. 

Even if you sell your business to someone else, these same obligations transfer to the new owner. 

What happens if you don’t follow the law? Any aggrieved employee can bring a court action against you and seek compensatory, punitive, and possibly even treble damages.

This is not how you get Connecticut back to work.  

Don’t waste another minute. Tell your lawmaker to oppose SB 658 before it’s too late.
