Boston Beer sues Downeast Cider, accuses former employee of stealing trade secrets - WCVB Boston

Boston Beer, the parent company of Samuel Adams and several other brands, is accusing a former employee of taking copies of proprietary information as he was leaving to go work for Downeast Cider in violation of non-disclosure and non-compete agreements. Both Boston Beer and Downeast Cider are both headquartered in Boston. Among Boston Beer's many brands is Angry Orchard hard ciders, which competes with Downeast Cider's products. The lawsuit, filed last week in Suffolk Superior Court, identified the former employee as Brian Soudant of Andover. It said he worked for Boston Beer from 2015 through this year as a manager in a series of roles involving strategic planning, business analysis and brand analysis. Boston Beer said Soudant submitted his resignation on April 10. The lawsuit also states that on April 24, four days before his resignation took effect, Soudant connected an external USB Device to his Boston Beer computer and copied confidential files.Video below: Downeast Cider featured on Made in Mass.Boston Beer argues that it maintains confidential information that provides "a significant competitive and economic edge over its competitors," and suggests that Downeast Cider could "unfairly identify, contact and undersell to Boston Beer's customers" if the information became known. "As an employee of Downeast, Soudant will be marketing products that are directly competitive with those sold by Boston Beer. He is thus in a position to, and will inevitably, use Boston Beer's confidential business information in direct competition with Boston Beer," the lawsuit states.According to the lawsuit, Boston Beer had warned Soudant prior to his resignation taking effect about the obligations included in his employment agreement. It also summarizes months of legal correspondence between Boston Beer, Soudant and Downeast Cider that preceded this legal action."Soudant has maliciously and willfully misappropriated Boston Beer's trade secret information by disclosure for a direct competitor," the lawsuit states. Boston Beer is asking the court for damages based on the alleged breach of the employment agreement; to recoup training costs and attorneys fees; and for an injunction prohibiting Soudant from sharing confidential information and working for Downeast Cider in the "niche market" of competition for one year.
